HMRC Success Stories
- We acted for a client in connection with an incorrect benefit being deducted from their tax code. Although the benefit ceased to be received, the client was unable to get HMRC to correct either their tax code for the years in question, or refund them the overpaid tax. For over five years, an incorrect tax code was applied to their salary; up to and including four years after the benefit had ceased.
- After our intervention and our complaint to the Adjudicator, we were successful in obtaining compensation for our client, an apology from HMRC to our client for failing to act on information in its possession and we were also successful in obtaining a refund from HMRC direct to our client for our fees incurred in resolving the issue. HMRC paid our client a four figure sum in total.
- Successfully negotiated with HMRC in connection with a client who had not filed any tax returns for over 10 years and was facing significant penalties. Was successful in obtaining penalty reductions to zero in all affected years and also succeeded in a refund for the client’s penalties paid so far.
- Obtaining rebates from HMRC on several occasions for professional fees paid to us by clients, when HMRC had the information in their possession and failed to act on it. On some of these occasions some of these fees that we were able to reclaim on behalf of the client were quite substantial.
- Represented a client in an HMRC enquiry where there was a dispute in law in regarding the disposal of business and where the client was deemed to be ineligible for Entrepreneurs’ Relief. Prepared the case on the client’s behalf showing why Entrepreneurs’ Relief was due.
Case was listed at the First Tier Tribunal from which HMRC withdrew shortly before the hearing, on advice from their counsel. This win saved the client approximately £60,000 in tax. - Assisting a client with a Stamp Duty Multiple Dwellings Relief Claim which resulted in a saving of stamp duty of over £50,000.
- A client affected by the Loan Charge contacted us and having reviewed his circumstances, we determined that the majority of his income was not subject to the Loan Charge and we therefore acted for him in connection with the enquiry.
Notwithstanding the client’s circumstances, HMRC pursued him incorrectly for over 4 years.
We were successful in bringing this to the Tribunal and the Tribunal ordered HMRC to close the enquiry within 3 months.
We were happy to bring matters to a conclusion.
